This page explains how to tell SheLoveShapeWear that something on this site infringes your copyright, and what we do when you tell us. It covers material posted by customers — product reviews and anything submitted with them — as well as product imagery supplied to us.

Reporting infringement

Send a written notice to info@sheloveshapewear.com with the subject line Copyright notice. Under the US Digital Millennium Copyright Act a notice has to contain all six of the following, so please include every one:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work you say has been infringed.
  3. Identification of the material you are asking us to remove, with enough detail for us to find it — a direct link to the page is best.
  4. Your address, telephone number and email address.
  5. A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act for them.

A notice missing any of these is not a valid DMCA notice, and we may come back to you for the missing part before acting.

What we do

We review every notice we receive. Where a notice is valid and the material is ours to remove, we remove or disable access to it promptly and tell whoever posted it that we have done so and why. We keep a record of notices and of repeat infringers, and we terminate accounts that infringe repeatedly.

If your material was removed

If we removed something you posted and you believe that was a mistake or a misidentification, you can send a counter-notification to the same address. It needs your signature, identification of the material and where it was, a statement under penalty of perjury that you believe in good faith it was removed by mistake, your contact details, and your consent to the jurisdiction of a federal court where you live — or, if you are outside the United States, where we are. If we receive one we may restore the material, and we will pass your counter-notification to the person who complained.

Misuse

Knowingly misrepresenting that material is infringing carries liability for damages under section 512(f) of the DMCA. Please be sure before you send a notice.

Canadian notices

We are based in Canada, where the Copyright Act operates a notice-and-notice regime rather than notice-and-takedown. If you send a notice under that regime we forward it to the person responsible for the material, as the Act requires, and keep the records it requires. That is separate from the DMCA process above, and sending one does not oblige us to remove anything.
